This Land Belongs to the Army is a 2014 documentary film by Maga.Tamizh Prabhagaran, a young journalist and film maker. This film exposes the genocidal war waged by the Sri Lankan Army and shows for the first time, the current uncensored reality in post war Sri Lanka. ⁣குமுதினி படகு 1985 மே 15 காலை 7:15 மணிக்கு நெடுந்தீவு மாவலித் துறைமுகத்தில் இருந்து 64 பயணிகளுடன் புறப்பட்டது. நயினாதீவு நோக்கிச் சென்று கொண்டிருக்கும் போது புறப்பட்ட அரைமணி நேரத்தின் பின் நடுக்கடலில் கண்ணாடி இழைப் படகில் வந்த இலங்கைக் கடற்படையினரால் வழிமறிக்கப்பட்டது. ஆறு பேர் முக்கோண கூர்க்கத்தியும் கண்டங்கோடலிகள் இரும்புக்கம்பிகள் சகிதம் குமுதினியில் ஏறினர். பின்புறமிருந்த பயணிகளை இயந்திர அறையின் முன்பக்கம் செல்லுமாறு மிரட்டினர். அவர்கள் அனைவரும் சென்றுவிட்டனர்.

பின்புறம் இருபுற இருக்கைகளுக்கு நடுவே பலகைகளினால் இயந்திரத்தில் இருந்து பின்புறம் செல்லும் ஆடு தண்டுப்பகுதியை அவர்கள் அகற்றினர். இருக்கை மட்டத்தில் இருந்து கிட்டத்தட்ட சுமார் 4 அடி ஆழமானதாக அது இருந்தது.

இதன்பின் பணியாளர்கள் உட்பட ஒவ்வொருவராக உள்ளே அழைக்கப்பட்டனர். அரைகுறைத் தமிழில் அவர்கள் கதைத்தனர். குமுதினியின் இருபக்க வாசல்களிலும் உள்ளும் வெளியும் கடற்படையினர் இருந்தனர். ஒவ்வொருவராக கடற்படையினர் அழைத்து கத்தியால் குத்தியும் கண்டங்கோடலியால் வெட்டியும் இரும்புக்கம்பியால் தாக்கியும் கொன்று அந்த ஆடு தண்டுப்பகுதியில் போட்டனர். இப்படி கொல்லப்படுபவர்கள் எழுப்பும் அவல ஒலி முன்புறம் இருப்பவர்களுக்கு கேட்கக்கூடாது என்பதற்காக அவர்கள் பெயரையும் ஊரையும் உரக்கச் சொல்லுமாறு பணிக்கப்பட்டனர். அவலக் குரல் எழுப்ப முடியாது இறந்தவர்கள் போல் இருந்தவர்களும் உண்டு.

கடுமையாகத் கடற்படை தாக்க குரல் எழுப்பியவர்கள் அதிகளவில் தாக்கப்பட்டு இறந்து விட்டார்கள் என கடற்படையினரால் கருதப்பட்டும் போடப்பட்டனர். பயணிகளில் ஒருவர் கடலில் குதிக்கவே அவருடன் சேர்ந்து வேறு சிலரும் கடலில் குதிக்கத் தொடங்கினர். இதனைக் கண்ட ஆயுத நபர்கள் அவர்கள் மீது துப்பாக்கிப் பிரயோகம் செய்தனர்.

⁣"The war is over and that leaves of lot questions unanswered," the former UN Sri Lanka spokesperson stressed. We explore the accusations tearing apart Sri Lanka. The war crimes charges levied against the Sri Lankan government including bombing safe zones and hospitals "suggest a determination to simply wipe out as many people as possible" commented a UN Special Rapporteur. Witnesses allege that the rebels are also guilty of war crimes; kidnapping and forcing children to fight. We meet the victims of this bitter war and hear their stories as two senior UN officials call for an investigation. "We can't just draw a line under this", a prominent political analyst emphasised. "Serious, hard questions of how we could do these things to each other" must be investigated.

⁣After the end of Sri Lanka’s civil war, families seeking accountability for state-sanctioned violence filed a suit against a man they say is a war criminal. A private eye was tasked with hunting down Gotabaya Rajapaksa (better known as Gota), Sri Lanka’s former defense minister. The P.I. found the alleged war criminal in Southern California, shopping at Trader Joe’s.
At the close of World War II, dozens of former Nazi leaders came to the United States. After decades of inaction, in 1979, President Jimmy Carter created a special unit within the Department of Justice dedicated to hunting down Nazi war criminals. Decades after passing the first substantive human rights statutes that make it possible to prosecute war criminals for crimes like torture and genocide, the U.S. has successfully prosecuted only one person under the laws. Sriskandarajah talks to experts about why prosecutors often take an “Al Capone” strategy to going after war criminals, pursuing them on lesser charges like immigration violations rather than human rights abuses.
With little action from the government to prosecute war criminals, victims of violence are instead using civil lawsuits to try to seek accountability. Lawyers at the Center for Justice & Accountability have brought two dozen cases against alleged war criminals and human rights violators – and never lost at trial. But when the lawyers share their evidence with the federal government, it often feels like the information disappears into a black box.
